General Terms of Use and Sale

These General Terms of Use and Sale (hereinafter the “Terms”) govern access to and use of the TIXIAN platform offered by KATEOS (hereinafter “TIXIAN”).

1. Purpose

The TIXIAN platform allows the automation of trading orders through the integration of external alerts, in particular TradingView, communication with platforms such as MetaTrader 5 (MT5) through a dedicated bot, as well as the statistical monitoring of trading accounts.

TIXIAN does not manage funds, does not execute orders on behalf of third parties and does not provide any investment advice.

3. Access to the service

Access to the service requires an Internet connection, compatible equipment and the creation of a user account.

4. Account creation

The User undertakes to provide accurate, complete and up-to-date information. They are responsible for the confidentiality of their credentials and for any use of their account.

5. Subscriptions, prices and payment

Subscriptions are offered at the prices displayed on the platform, in euros including all taxes, unless otherwise stated.

Payment is made online by bank card through the secure Stripe platform. Payment data is entered and processed directly by Stripe and is never stored on our servers.

Stripe implements high security standards for payment processing and is certified as a PCI DSS Level 1 service provider.

6. Automatic renewal

When subscribing, automatic renewal can be enabled. The User can disable it at any time from their client area.

In the event of a payment failure during automatic renewal, access to the services may be suspended until the situation is regularized.

7. Risk warning

Trading involves significant risks of loss. The User acknowledges that they use the platform under their sole responsibility. TIXIAN provides no personalized recommendation, no investment advice and no guarantee of performance.

8. Liability

TIXIAN cannot be held liable for any loss, direct or indirect damage, or financial consequences related to the User’s trading decisions, nor for malfunctions or unavailability attributable to third-party services, the Internet, brokerage platforms, TradingView, MetaTrader, Stripe, or any other external provider.

9. Personal data, processing by third parties, cookies and local storage

The processing of personal data is described in the Site’s Privacy Policy.

Payment processing is handled by Stripe Payments Europe, Ltd. As part of payment services, Stripe intervenes to process transactions and applies its own security and compliance measures.

The Site uses cookies and storage mechanisms that are strictly necessary for its operation, security, the memorization of certain user preferences, and the operation of the secure Stripe payment module.

No advertising or behavioural targeting cookies are used by TIXIAN on this website.

Where certain forms use a third-party anti-bot protection service subject to consent, that service is loaded only after the user’s explicit agreement.

10. Intellectual property

All elements making up the TIXIAN platform, including texts, graphics, logos, interfaces, software, databases and content, are protected by intellectual property law and remain the exclusive property of TIXIAN or its partners.

11. Suspension – Termination

In the event of non-compliance with these Terms, fraudulent use or abusive use of the service, TIXIAN reserves the right to suspend or terminate the User’s account, without prejudice to any additional action.

12. Governing law and competent jurisdiction

These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent courts shall be those within the jurisdiction of Lyon, subject to mandatory rules of jurisdiction.
